City, TWIA Break Even After Suit

According to the SE Texas Record, the Texas First Court of Appeals has upheld a jury ruling where neither party receives a payout in a 2012 case between League City, Texas, and the Texas Windstorm Insurance Association (TWIA).

League City sued for $13 million after it claimed TWIA did not pay for damages to city buildings after Hurricane Ike in 2008. Hurricane Ike struck Texas in 2008 and caused billions of dollars in damage throughout the state. After the hurricane struck, TWIA paid $750,000 to League City for damage claims, but this suit was filed nearly four years later without notice.

The jury in the case found that TWIA failed to adhere to the Texas Insurance Code, but it also found that League City failed to give notice of damages, or provide documentation of repair expenses. As a result, neither party received indemnities in its favor.
